3. SECURITY

3.1 We have taken steps to ensure the security and privacy of our systems and our users data and personal information. Our Website uses a market leading secure payment systems, PayPal and Nochex. At checkout you have the choice to pay via one of two secure servers to PayPal or Nochex, a encrypted secure page where you complete your order by providing your credit card details.

Your browser encrypts the information that you type and the Paypal or Nochex server decodes it. 3.2 When you choose to pay online, your card details will not be available to bpure.co.uk staff. Your card details are input into either the PayPal or Nochex secure site depending on your choice of payment system. bpure.co.uk does not have access to them at any time. Your card and address details are security checked and verified with the relevant card issuer and your payment is pre-authorised. You will receive a message in your internet browser window to tell you that payment has been authorised, and we will receive confirmation from the payment provider when payment is received.

3.3 We are not liable for any unauthorised, erroneous or denied payments.

4. PLACING AN ORDER WITH US & REFUNDS

4.1 You place your order by clicking on the submit button at the end of the online order process. You will be guided through the process of placing an order by a series of simple instructions on the website.

4.2 Once you have placed your order, we will send you an acknowledgement email detailing the Goods/Products that you have ordered, a payment reference and the value of your order which will be debited from your credit/debit card.

4.3 Non-acceptance of an order may be a result of one of the following:

The product you ordered being unavailable from stock or,

Our inability to obtain authorisation for your payment or,

The identification of a pricing or product description error or,

You do not meet the eligibility-to-order criteria set out in these Terms.

4.4 If we are unable to fulfil your order or part of your order (i.e. in relation to any non-acceptance of an order), we will either contact you by email or telephone to advise you of this as soon as possible or in the the event of any item being either out of stock or discontinued we will amend your order with an equivalent item or not include the item so not to delay your order. You will be given a refund of what you have paid in relation to any such non-fulfilled order or part item. Please note that the only exception to this refund policy is in relation to either underpayment for your goods or delivery costs and not fulfilling offer criteria, or bespoke, especially ordered or customised Goods in such cases we CANNOT offer a refund of any kind.

4.5 All products are subject to availability. Back ordered products include items that are not currently in stock. Should this occur, we would email you with the anticipated dispatch date. If for any reason we determine that a back ordered item will no longer be available, we will notify you immediately by email, cancel the item from your order and refund you in full, or you may choose an alternative product of the same value.

5. PRICE

5.1 The price of the Goods/Products shall be the price quoted on the website on the date of acceptance of the order by us. If we find a pricing error on our website we will inform you as soon as possible and give you the opportunity, if you wish, of reconfirming your order at the correct price or cancelling it. For the avoidance of doubt, we are neither bound nor liable in any way to provide any Goods/Product to you on the basis of any pricing error (obvious or otherwise) found or posted on our website. 5.2 Please note, that as of 1st March 2007, bhive is VAT registered and will include VAT where applicable.

5.3 The price of products does not include delivery. You will pay the delivery charges by the method specified in your order for transport and packaging as quoted on the website on the date of acceptance of the order.

5.4 Price and availability information is subject to change without prior notice.

6. PAYMENT

6.1 Payment of the price of an order must be received by bhive and cleared before delivery.

6.2 We accept MasterCard, Visa, Maestro, Solo and Switchfor online payment. All transactions are in pounds sterling (£). If paying by credit or debit card, please advise us of the billing address your card provider holds on file. By using this card you are confirming that the credit or debit card that is being used is yours. We cannot be liable for any unauthorised transactions nor can we be held liable for any denied payments which are a result of the information provided by you.

6.3 All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will contact you as the buyer and card holder to advise. However, we shall not be responsible for any costs or inconvenience caused by a subsequent delay, denial or payment or subsequent non-delivery of any products on the basis of the above.

6.4 If you would prefer not to send your credit or debit card details over the internet, you are still able to choose the goods you require using our shopping cart facility. At checkout you simply choose your preferred payment option: Payment by Credit Card through PayPal, Cheque or Telephone Ordering. We would be delighted to take payment for your order by telephone. 6.5 Payment may be made by personal cheque using our shopping cart facility. Following checkout simply write to us at bhive house, One Carlingford Road, Stockton Heath, Warrington, Cheshire WA4 6SA. quoting your Order ID and enclosing a sterling pound cheque drawn on a UK bank account made payable to "bhive". Please ensure that you write your name, address and order ID on the reverse of the cheque. Please note that products will not be despatched until payment by personal cheque has cleared.

6.6 Any losses sustained by the transmission of personal information by email or internet links shall be borne exclusively by you.

6.7 Charges to your credit card will be shown as Paypal or Nochex depending on which system you chose to pay through.

6.8 bhive intends to provide you with the safest and most secure shopping experience possible. Since offering anf technologies change, we reserve the right to change, modify, add or remove portions of our Privacy Policy at any time without prior notice. If policy changes are substantial, we will notify our customers via email. Please periodically review our Privacy Policy for changes. 7. DESPATCH

7.1 Every effort is made to ensure that your order is despatched within 7-10 working days of order paid by credit/debit card or clearance of cheque, subject to events that are beyond our reasonable control. We use all reasonable endeavours to adhere to the delivery times.

7.2 If your ordered item is temporarily out of stock, we will order this item for you and despatch your order as soon as possible. You will always be emailed with an option to cancel this order should you wish.

7.3 We use Royal Mail or specialist mailing or couriers, depending on the achievable service level. Delivery in the UK by these methods usually takes between 3-7 days and up to 10 days where necessary. In light of these delivery times, you accept that time is not of the essence although we will make every effort to ensure that your order is processed and your Goods delivered as quickly as possible. 7.4 Please note that we do not accept any liability whatsoever for any delay in delivery caused by third parties (including Royal Mail or any mailing or courier service companies) that we may use to deliver your order.

8. DELIVERY

8.1 The method and address for delivery shall be as specified in your order. Parcels may require a signature on delivery. If you will not be at your home address during normal office hours, you may wish to give us an alternative delivery address, such as a neighbour, family member or a work address. Please ensure we have the full address including your full postal code (PO Box addresses are not acceptable for delivery) and a contact telephone number.

8.2 Upon receipt of the Goods you must inspect the Goods. Upon delivery of the Goods to you, we will also provide you with sufficient details to enable you to:

10. RISK AND OWNERSHIP

10.1 Risk of damage or loss of the Goods shall pass to you on delivery or, if you fail to take delivery of the Goods, at the time when the Goods are delivered (or delivery is attempted) to you in accordance with your instructions.

10.2 Title in the Goods shall pass to you upon delivery of the Goods and on our receipt of full payment. Legal ownership of the Goods will immediately revert to us if we refund any such payment to you or if the Goods are returned in accordance with any cancellation, refund, return or exchange policy as posted on this website.

11. CANCELLATION, RETURNS & EXCHANGES

11.1 We are sure you will be delighted with your purchases. If for any reason your are not satisfied with your purchase, we would be pleased if you decide to return the Goods, unused and in their original packaging together with the return form supplied with the delivery, within 14 working days from receipt of the Goods to bhive house, One Carlingford Road, Stockton Heath, Warrington, Cheshire WA4 6SA.

Please note that, for reasons of hygiene, we are unable to offer refunds or exchanges on any opened or used product. Additionally, we cannot offer any refunds for customised or bespoke Goods which are not damaged or defective.

11.2 We will not accept any responsibility for loss or damage to Goods returned in this way until they are received at our above address. We strongly recommend that returns are sent by 'insured registered delivery' and the original proof of posting is kept. Please note that we are not responsible for return postage other than for incorrectly supplied, defective or damaged Goods. We regret, however, that we cannot refund return postage costs.

11.3 Once we receive the Goods in their original condition, any payments made by you for your purchase will be refunded in full within 30 working days or, where applicable, replacement Goods will be despatched to you as soon as possible with no further costs for you.

11.4 If your purchase from bhive is found to be faulty, damaged or unsatisfactory, please return it to us at the above address in 12.1 for a refund of the product(s). Refunds for valid claims will be made via the same method of payment as used to place your order. Less any Paypal or Nochex fees incurred.

11.5 You may cancel your order by informing us of this at: organics@bhiveshop.co.uk within the specified delivery due time. We will refund your money within 30 days of your cancellation.

12. DAMAGED GOODS

12.1 You should inspect the Goods when you receive them for damage or defects. In the event that your order is incorrectly delivered or found to be damaged or defective, please contact us within 2 working days of receipt of Goods. The Goods should be promptly sent back to us including the original invoice and packaging to bhive house, One Carlingford Road, Stockton Heath, Warrington, Cheshire WA4 6SA. We will then offer you a full refund or replacement including postage.

13. DESCRIPTION OF GOODS

13.1 We take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct at the time when the relevant information was entered onto the system. However, although we aim to keep the Website as up to date as possible, we do not warrant that product descriptions, colours or other content available on the Website are accurate, complete, reliable, current, or error-free.
